In the exercise of the powers conferred on the National Assembly for Wales by sections 28D(1), (2), (8) and (9) and 67(3)(a) of the Disability Discrimination Act 1995[1], the National Assembly for Wales makes the following Regulations[2]:
Name, commencement and application

- (1) These Regulations are called the Disability Discrimination (Prescribed Periods for Accessibility Strategies and Plans for Schools) (Wales) Regulations 2003 and shall come into force on 8th October 2003.
(2) These Regulations apply in relation to Wales.
Prescribed intervals for the preparation of accessibility strategies and accessibility plans

For the purposes of sub-sections (1) and (8) of section 28D of the Disability Discrimination Act 1995, accessibility strategies and accessibility plans must be prepared every three years.
Prescribed periods for accessibility strategies and accessibility plans

For the purposes of sub-sections (2) and (9) of section 28D of the Disability Discrimination Act 1995, the prescribed period in each case is to be a period of three years beginning on 1st April, the period of the first accessibility strategy and (subject to regulation 4) the first accessibility plan beginning on 1st April 2004.

In respect of a school established after 1st April 2004, for the purposes of sub-section (9) of section 28D of the Disability Discrimination Act 1995, the prescribed period for that school's first accessibility plan is to be the period beginning on the date the school is established and ending on the date on which the current accessibility plan for the school would have ended had the school been established on or before 1st April 2004.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations, which are made under section 28D of the Disability Discrimination Act 1995, prescribe that:
- local education authorities are required to prepare accessibility strategies every three years;
- responsible bodies for schools are required to prepare accessibility plans every three years;
- the periods of the accessibility strategies and accessibility plans are to be three years commencing on 1st April and ending on 31st March and the first such strategy and the first such plan is to begin on 1st April 2004 and end on 31st March 2007; and
- where a school is established after 1st April 2004, the prescribed period for that school's first accessibility plan is to commence on the date the school is established and is to end on the date the current plan for the school would have come to an end had the school been established on or before 1st April 2004.
