The National Assembly for Wales makes the following Regulations in exercise of the powers conferred upon it by sections 82(8) and (9) and 105(1) of the Local Government Act 2000[
1].
Citation, commencement and application
1.
- (1) These Regulations may be cited as the Code of Conduct (Non-Qualifying Local Government Employees) (Wales) Regulations 2001 and shall come into force on 28 July 2001.
(2) These Regulations apply to Wales only.
Interpretation
2.
In these Regulations -
"the Act" ("y Ddeddf") means the Local Government Act 2000;
"firefighter" ("diffoddwr tân") means a person who is a member of a fire brigade maintained by a fire authority and whose conditions of service involve a liability to engage in fire-fighting within the meaning of section 38(1) of the Fire Services Act 1947[2];
"fire authority" ("awdurdod tân") means an authority which for the time being is constituted a fire authority by the Fire Services Act 1947 or any combination scheme made thereunder;
"teacher" ("athro neu athrawes") means a person who is employed as a teacher by a Local Education Authority.
Description of employees

The following descriptions of employee are specified for the purposes of section 82(8) of the Act -
(a) a firefighter, and
(b) a teacher.

EXPLANATORY NOTE
(This note does not form part of the Regulations.)
Part III of the Local Government Act 2000 ("the Act") establishes a new ethical framework for local government in Wales.
Section 82(2) of the Act provides that the National Assembly for Wales may, by order, issue a code as regards the conduct of certain employees of relevant public authorities in Wales ("the code of conduct"). The relevant authorities are community, county and county borough councils, fire authorities and National Park authorities but not police authorities.
Under section 82(8) of the Act, the National Assembly for Wales may make regulations which specify the descriptions of employee to which the code of conduct does not apply.
These Regulations specify such descriptions of employee, namely, teachers and fire-fighters who are employees of relevant authorities in Wales.
