The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[
1] and now vested in him[
2], and of all other powers enabling him in that behalf:
1.
This Order may be cited as the A5195 Trunk Road (Birmingham Northern Relief Road Link Road) (Detrunking) Order 2004 and shall come into force on 4th November 2004.
2.
In this Order -
(1) all measurements of distance are measured along the route of the relevant highway;
(2)
(i) "the plan" means the plan folio numbered HA 10/OD/488 consisting of sheet 1 and marked "The A5195 Trunk Road (Birmingham Northern Relief Road Link Road) (Detrunking) Order 2004", signed by authority of the Secretary of State for Transport and deposited at DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA;
(ii) "principal road" as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State;
(iii) "the trunk road" means the A5195 Trunk Road.
3.
The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a principal road from the date on which the Order comes into force.

SCHEDULE
LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD
The lengths of the trunk road ceasing to be a trunk road are situated:
(i) between its junction with the A5 at Brownhills (marked "A" on the plan) and the Boundary of Walsall and the County of Staffordshire at New Town (marked "B" on the plan), a distance of approximately 0.2 km, all in Walsall, and
(ii) between the Boundary of Walsall and the County of Staffordshire at New Town (marked "B" on the plan) and the southern boundary of its roundabout junction with the M6 Toll, including the circulatory carriageway of that roundabout (marked "C" on the plan), a distance of approximately 1.1 km, all in the County of Staffordshire.
The two lengths are shown by broad black dashes on the plan.
