The Secretary of State for Transport, in exercise of the powers conferred upon him by section 163 of the Greater London Authority Act 1999[
1] hereby makes the following Order:
Citation and commencement
1.
This Order may be cited as the Transport for London (White City) Order 2004 and shall come into force on 29th April 2004.
Consent
2.
- (1) The Secretary of State hereby gives consent to Transport for London for the grant of a leasehold interest in land at Wood Lane, London W12 as specified in Schedule 1 for a term of more than fifty years.
(2) The Secretary of State hereby gives consent to Transport for London for the grant of a leasehold interest in land near Wood Lane, London W12 as specified in Schedule 2 for a term of more than fifty years.
(3) The Secretary of State hereby gives consent to Transport for London for the grant of a leasehold interest in land near Wood Lane, London W12 as specified in Schedule 3 for a term of more than fifty years.
(4) The Secretary of State hereby gives consent to Transport for London for the disposal of the freehold interest in land near Caxton Road, London W12 as specified in Schedule 4.
(5) The Secretary of State hereby gives consent to Transport for London for the grant of a leasehold interest in land at the White City Depot, London W12 as specified in Schedule 5 for a term of more than fifty years.
(6) The Secretary of State hereby gives consent to Transport for London for the grant of a leasehold interest in land at 10B Wood Lane, London W12 as specified in Schedule 6 for a term of more than fifty years.

EXPLANATORY NOTE
(This note is not part of the Order)
Section 163 of the Greater London Authority Act 1999 ("the Act") prohibits Transport for London from disposing of the freehold interest in any land which is or has been operational land, or granting a leasehold interest in such land for a term of more than fifty years, without the consent of the Secretary of State. Operational land is defined in section 163(8) of the Act. Consent is not required in respect of land which has been operational land if a period of at least five years has elapsed since the land was last operational land (section 163(3)).
Under section 164 of the Act Transport for London is required to ensure that none of its subsidiaries does anything which Transport for London has no power to do (including anything which Transport for London has no power to do because the consent of the Secretary of State has not been obtained). The parcels of land identified in Schedules 1 and 2 of this Order have been operational land within the past five years. The parcels of land identified in Schedules 3, 4, 5 and 6 of this Order are currently operational land. The grant of leasehold interests for terms of more than fifty years in the parcels of land identified in Schedules 1, 2, 3, 5 and 6, and the disposal of the freehold interest in the parcel of land identified in Schedule 4, therefore require the consent of the Secretary of State. London Underground Limited, a subsidiary of Transport for London, shall make the disposal of the freehold interest and the grants of the leasehold interests which are the subject matter of the Order.
By this Order the Secretary of State for Transport gives consent to Transport for London for the grant of leasehold interests for terms of more than fifty years in the parcels of land identified in Schedules 1, 2, 3, 5 and 6 of the Order. By this Order the Secretary of State for Transport also gives consent to Transport for London for the disposal of the freehold interest in the parcel of land identified in Schedule 4 of the Order.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
