The Products of Animal Origin (Third Country Imports) (England) (Amendment No. 2) Regulations 2004

  Coming into force 10th March 2004 

The Secretary of State, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on her by that section, makes the following Regulations:

Title, extent and commencement
     1. These Regulations may be cited as the Products of Animal Origin (Third Country Imports) (England) (Amendment No. 2) Regulations 2004; they apply in relation to England only and come into force on 10th March 2004.

Amendments to the Products of Animal Origin (Third Country Imports) (England) Regulations 2003
    
2. The Products of Animal Origin (Third Country Imports) (England) Regulations 2003[3] shall be amended in accordance with these Regulations.

Substitution of regulation 62
     3. For regulation 62 there shall be substituted the following - 

    " Contraventions
        
    62. Any person who - 

      (a) contravenes a provision of these Regulations, other than - 

        (i) the provisions contained in regulations 8(2) and 19(3) referring to payment of costs; and

        (ii) the provisions contained in regulations 23(7), 28, 43(5), 45(2) and 55; or

      (b) fails to comply with a notice served upon him under these Regulations,

    shall be guilty of an offence.".

Amendment to regulation 65
    
4. For paragraph (1) of regulation 65 there shall be substituted the following - 

        " (1) Any notice served under these Regulations by the Secretary of State, the Agency, an official veterinary surgeon, an official fish inspector or an authorised officer may be served on a person by - 

      (a) delivering it to that person;

      (b) leaving it at his proper address; or

      (c) posting it to his proper address.".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Products of Animal Origin (Third Country Imports) (England) Regulations 2003 (S.I. 2003/3177) by providing in regulation 62 that contravention of certain provisions does not constitute an offence and by correcting an error in regulation 65.

A regulatory impact assessment has not been prepared for these Regulations.
