Whereas a draft of this Order has been laid before Parliament in accordance with section 1(3) of the European Communities Act 1972[
1] and has been approved by a resolution of each House of Parliament:
Now, therefore, Her Majesty, in exercise of the powers conferred upon Her by section 1(3) of the European Communities Act 1972 or otherwise in Her Majesty vested, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:
1.
This Order may be cited as the European Communities (Definition of Treaties) (Euro-Mediterranean Agreement establishing an Association between the European Communities and their Member States and the People's Democratic Republic of Algeria) Order 2004. It shall come into force in respect of the treaty specified in the Schedule to this Order on the date on which the treaty enters into force for the United Kingdom. This date will be notified in the London, Edinburgh and Belfast Gazettes.
2.
The treaty specified in the Schedule to this Order is to be regarded as a Community Treaty as defined in section 1(2) of the European Communities Act 1972.

SCHEDULE
The Euro-Mediterranean Agreement establishing an Association between the European Communities and their Member States, of the one part, and the People's Democratic Republic of Algeria of the other part signed at Valencia on 27th April 2002[
2].
EXPLANATORY NOTE
(This note is not part of the Order)
This Order declares the Euro-Mediterranean Agreement establishing an Association between the European Communities and their Member States and the People's Democratic Republic of Algeria, signed on 27th April 2002, to be a Community Treaty as defined in section 1(2) of the European Communities Act 1972. The Agreement provides a framework for regular political dialogue between the parties, will establish a free trade area over a transitional period, and contains provisions concerning, inter alia, the right of establishment and supply of services, the movement of capital, competition policy and economic, social and cultural co-operation. The principal effect of declaring this Agreement to be a Community Treaty as so defined is to bring into play, in relation to it, the provisions of section 2 of the European Communities Act 1972 which provide for the implementation of treaties so specified.
