In exercise of the powers conferred on the Secretary of State by sections 19 and 42(6) and (7) of the Teaching and Higher Education Act 1998[
1] the Secretary of State for Education and Skills hereby makes the following Regulations:

These Regulations may be cited as the Education (Induction Arrangements for School Teachers) (Consolidation) (England) (Amendment) Regulations 2001 and shall come into force on 1st January 2002.
2.
The Education (Induction Arrangements for School Teachers) (Consolidation) (England) Regulations 2001[
2] shall be amended as follows.

In regulation 12, "16, 16A or" shall be substituted for "16 or".
4.
In regulation 16, sub-paragraph (5)(a)(v) shall be deleted.

The following regulation shall be inserted after regulation 16 -
"
Extended induction period for qualified teachers who have yet to pass the numeracy skills test
16A.
- (1) This regulation shall apply in the case of a teacher who qualified between 1st May 2000 and 30th April 2001 and who has -
(a) completed an induction period or an extended induction period under regulation 16(3); and
(b) achieved the induction standards mentioned in regulation 15 save that, on 1st January 2002, he has yet to pass the numeracy skills test.
(2) The appropriate body shall not take any decision pursuant to regulation 16(3) in respect of such a person.
(3) The appropriate body shall notify the General Teaching Council for England of the persons to whom this regulation applies as soon as practicable after 1st January 2002.
(4) The induction period of a person to whom this regulation applies shall be extended in accordance with paragraph (5).
(5) The period of extension shall begin on the first school day after 1st January 2002 and shall end on the last school day before 31st August 2002 or if earlier on the date when the person passes the numeracy skills test.
(6) A person who serves an induction period extended by virtue of this regulation shall give written notification to the General Teaching Council for England when he passes numeracy skills test.
(7) Regulations 8, 10 and 12 to 15 apply in relation to a person serving an induction period extended by virtue of this regulation.
(8) Notification under paragraph (3) and (6) may be given by facsimile, electronic mail or other similar means which are capable of producing a document containing the text of the communication, and notification sent by such method shall be regarded as given when it is received in legible form.
(9) In this regulation, the "numeracy skills test" means the numeracy test for the time being determined by the Secretary of State as an induction standard under regulation 15 and applicable in the case of the teacher.".

The following regulation shall be inserted after regulation 18 -
"
Satisfactory completion of induction for qualified teachers passing the numeracy skills test after 31st August 2002.
18A.
- (1) This regulation shall apply in the case of a teacher who qualified between 1st May 2000 and 30th April 2001 and who has -
(2) The appropriate body shall not take any decision pursuant to regulation 16(3) in respect of such a person.
(3) The appropriate body shall notify the General Teaching Council for England of the persons to whom this regulation applies as soon as practicable after 31st August 2002.
(4) The employer of a person to whom this regulation applies shall secure the termination of his employment as a teacher so that the termination takes effect on completion of his induction period or extended induction period.
(5) A person to whom this regulation applies shall not be employed as a teacher in a relevant school under paragraph 4 of Schedule 2.
(6) The induction period of a person to whom this regulation applies shall be satisfactorily completed when he passes the numeracy skills test.
(7) A person to whom this regulation applies shall give written notification to the General Teaching Council for England when he passes the numeracy skills test.
(8) Notification under paragraphs (3) and (7) may be given by facsimile, electronic mail or other similar means which are capable of producing a document containing the text of the communication, and notification sent by such method shall be regarded as given when it is received in legible form.
(9) In this regulation the "numeracy skills test" has the same meaning as in regulation 16A.".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These regulations amend the Education (Induction Arrangements for School Teachers) (Consolidation) (England) Regulations 2001 (S.I. 2001/2897).
Regulations 16A and 18A make provision in respect of teachers who qualified between 1st May 2000 and 30th April 2001, and who have satisfied all induction standards save passing the numeracy skills test.
Under regulation 16A an extension of the induction period will be permitted until 31st August 2002 or, if earlier, until the date on which the numeracy skills test is passed.
Under regulation 18A qualified teachers who have yet to pass the numeracy skills test on the 31st August 2002, (or if later, at the end of their induction period), will not be permitted to continue to be employed as a teacher and their induction period will be satisfactorily completed only when the numeracy skills test is passed.
