The Secretary of State, in exercise of the powers conferred upon her by paragraph 4 of Schedule 7 to the Postal Services Act 2000[
1], hereby makes the following Order:
Citation and Commencement
1.
This Order may be cited as the Postal Services Act 2000 (Disclosure of Information) Order 2001 and shall come into force on 1 December 2001.
Modifications to Schedule 7
2.
- (1) Paragraph 3 (other permitted disclosures) of Schedule 7 to the Postal Services Act 2000 is modified as follows.
(2) In sub-paragraph (1)(c), for "the Financial Services Act 1986[
2]" substitute "the Financial Services and Markets Act 2000[
3]".
(3) In sub-paragraph (2), delete paragraphs (h) and (l) and, at the end, add -
"
(s) the Financial Services Authority,
(t) the Gas and Electricity Markets Authority,
(u) the Gas and Electricity Consumer Council.".
(4) For sub-paragraph (3), substitute -
"
(3) The enactments and instruments are -
(a) the Industrial and Provident Societies Act 1965[4],
(b) the Industrial and Provident Societies Act 1967[5],
(c) the Trade Descriptions Act 1968[6],
(d) the Friendly and Industrial and Provident Societies Act 1968[7],
(e) the Fair Trading Act 1973[8],
(f) the Consumer Credit Act 1974[9],
(g) the Friendly Societies Act 1974[10],
(h) the Industrial and Provident Societies Act 1975[11],
(i) the Industrial and Provident Societies Act 1978[12],
(j) the Estate Agents Act 1979[13],
(k) the Credit Unions Act 1979[14],
(l) the Competition Act 1980[15],
(m) the Telecommunications Act 1984[16],
(n) the Airports Act 1986[17],
(o) the Gas Act 1986[18],
(p) the Insolvency Act 1986[19],
(q) the Building Societies Act 1986[20],
(r) the Consumer Protection Act 1987[21],
(s) the Electricity Act 1989[22],
(t) the Broadcasting Act 1990[23],
(u) the Property Misdescriptions Act 1991[24],
(v) the Water Industry Act 1991[25],
(w) the Water Resources Act 1991[26],
(x) the Friendly Societies Act 1992[27],
(y) the Railways Act 1993[28],
(z) the Coal Industry Act 1994[29],
(aa) the Broadcasting Act 1996[30],
(bb) the Competition Act 1998[31],
(cc) the Financial Services and Markets Act 2000[32],
(dd) the Regulation of Investigatory Powers Act 2000[33],
(ee) the Utilities Act 2000[34],
(ff) Part I of the Transport Act 2000[35],
(gg) the Insolvency Act 2000[36],
(hh) the Water and Sewerage Services (Northern Ireland) Order 1973[37],
(ii) the Audit (Northern Ireland) Order 1987[38],
(jj) the Consumer Protection (Northern Ireland) Order 1987[39],
(kk) the Insolvency (Northern Ireland) Order 1989[40],
(ll) the Electricity (Northern Ireland) Order 1992[41],
(mm) Part IV of the Airports (Northern Ireland) Order 1994[42],
(nn) the Gas (Northern Ireland) Order 1996[43],
(oo) the Water (Northern Ireland) Order 1999[44],
(pp) the EC Competition Law (Articles 84 and 85) Enforcement Regulations 2001[45],
(qq) any subordinate legislation made for the purpose of securing compliance with the Directive of the Council of the European Communities of 10th September 1984 (No. 84/450/EEC) on the approximation of the laws, regulations and administrative provisions of the member States concerning misleading advertising.".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order modifies paragraph 3 of Schedule 7 to the Postal Services Act 2000. Paragraph 1 of Schedule 7 prohibits the disclosure of certain information obtained under the Act. Paragraph 2 permits the disclosure of that information with the consent of the person to whom it relates. Paragraph 3 sets out other circumstances in which disclosure is permitted.
