The Secretary of State for Transport, Local Government and the Regions, in exercise of the powers conferred by section 13 of the Tyne and Wear Act 1976[
1] and of all other powers enabling him in that behalf, hereby makes the following Order:
1.
This Order may be cited as the Tyne Tunnel (Revision of Tolls and Traffic Classification) Order 2001 and shall come into force on 28 August 2001.

The tolls authorised in pursuance of the Tyne and Wear Act 1976 are hereby revised so that, save as provided in article 3 below, the tolls which the Tyne and Wear Passenger Transport Authority may demand and recover in respect of all traffic passing through and into the tunnel shall be those specified in the Schedule to this Order from the date on which this Order comes into force.

No tolls shall be charged in respect of any vehicle which is not chargeable with any duty under the Vehicles (Excise) Act 1971[
2] by virtue of section 7(2) of that Act.

In this Order -
"motor cycle" means a mechanically propelled vehicle having less than four wheels and, in a case where a cabin is provided, the cabin of which is not so constructed as to enclose the driver and any passenger;
"the tunnel" means Work No. 2 referred to in section 12 of the Tyne and Wear Act 1976;
"maximum gross weight" has the meaning given by regulation 3 of the Motor Vehicles (Construction and Use) Regulations 1986[3].

The Tyne Tunnel Tolls (Revision of Tolls) Order 1999[4] is hereby revoked.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order, made in consequence of a representation by the Tyne and Wear Passenger Transport Authority, increases the toll for use of the Tyne Tunnel by cars and most minibuses and light goods vehicles from 80p to £1.00 and increases the toll for use of the Tyne Tunnel by heavy goods vehicles from £1.00 to £1.20. The tolls for motor cycles remain unchanged. The Order also introduces discounts for permit holders of all classes of vehicles and rearranges the classes so that cars, most minibuses and light goods vehicles are now Class 2 and heavy goods vehicles are now Class 3 (previously the position was reversed).
