The Secretary of State for the Environment, Transport and the Regions makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980[
1] and now vested in him[
2] and of all other powers enabling him in that behalf.
1.
This Instrument may be cited as The Kingston upon Hull City Council (Millennium Bridge) Scheme 2000 Confirmation Instrument 2001 and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.
2.
The Kingston upon Hull City Council (Millennium Bridge) Scheme 2000 ("the Scheme") is hereby confirmed with modifications.
3.
The Scheme as confirmed is set out in the Schedule hereto (including the plans) and copies of the Scheme with its accompanying plans as modified are deposited at the offices of the Department of the Environment, Transport and the Regions, Floor 13 (IMD), Ashdown House, St. Leonards on Sea, Hastings, East Sussex TN37 7GA, and at the offices of the Kingston upon Hull City Council, The Guildhall, Alfred Gelder Street, Kingston upon Hull, HU1 2AA.

THE SCHEDULE
KINGSTON UPON HULL CITY COUNCIL (MILLENNIUM BRIDGE) SCHEME 2000
The Kingston upon Hull City Council (hereinafter referred to as "the Council") makes this Millennium Bridge Scheme (hereinafter referred to as "the Scheme") in exercise of its powers under Section 106(3) of the Highways Act 1980 and of all other powers enabling it in that behalf:-

The Council is authorised to construct over the navigable waters of the River Hull the bridge specified in the Schedule to this Scheme as part of the highway which it is proposing to construct and improve between Tower Street and Humber Street close to the mouth of the River Hull in the City of Kingston upon Hull.
2.
The proposed highway is to be a highway maintainable at the public expense by the Council and the Scheme will link the east and west banks of the River Hull.
3.
This scheme may be cited as the Kingston upon Hull City Council (Millennium Bridge) Scheme 2000.

THE SCHEDULE TO THE SCHEME
PLANS AND SPECIFICATIONS OF THE MILLENNIUM BRIDGE IN ACCORDANCE WITH S.107 HIGHWAYS ACT 1980
The location and general design of the bridge are shown on the plan numbered FA 05-134 A marked "Millennium Foot Bridge WP 9020" sealed with the Corporate Common Seal of the Council and deposited at the Guildhall, Kingston upon Hull and in the offices of the Secretary of State for the Environment, Transport and the Regions.
POINTS OF COMMENCEMENT AND TERMINATION
From a point on the west bank of the River Hull approximately 16 metres south of the junction of Humber Street and High Street.
To a point on the east bank of the River Hull leading into The Deep Millennium Project approximately 162 metres north of Sammy's Point and approximately 40 metres south of the River Hull Tidal Surge Barrier.
SPAN
The deck will have a single swing span of 20 metres (minimum).
HEADWAY
When swung the deck will be swung to a clear position adjacent to the east bank of the River Hull completely clear of the navigable waterway.
When open to traffic the deck will have a headway of 3.2 metres above High Water Ordinary Spring Tides over the navigation Channel when the depth of the water is 3.6 metres above Ordnance Datum Newlyn.
WATERWAY
The deck will have a minimum clear navigable waterway of 16 metres at the Statutory Defence Level of 6.30 metres above Ordnance Datum Newlyn.
OVERALL DIMENSIONS
The Bridge will be 4.0 metres wide overall between parapets and will be constructed of steel superstructures and reinforced concrete and steel abutments on piled foundations. The Bridge will be combined pedestrian and cycle path, unsegregated.
OPERATION
The bridge wil be manned similarly to other River Hull bridges. Operatives are able to move the bridge 3 hours before and 2 hours after high water times. Vessels will not be kept waiting at the bridge for more than 15 minutes. When vessels require passage through, they will sound their horn 3 times to alert the operatives. Larger vessels with ship-to-shore radio will contact the Millennium Bridge direct to advise of requirements.
