The Education (Adjudicators Inquiry Procedure etc.) (Amendment) Regulations 2001

  Made 2nd April 2001 
  Laid before Parliament 4th April 2001 
  Coming into force 1st May 2001 

In exercise of the powers conferred on the Secretary of State by paragraph 5 of Schedule 5 to the School Standards and Framework Act 1998[1], the Secretary of State for Education and Employment, after consultation with the Council on Tribunals in accordance with section 8 of the Tribunals and Inquiries Act 1992[2], hereby makes the following regulations:

Citation and commencement
     1. These Regulations may be cited as the Education (Adjudicators Inquiry Procedure etc.) (Amendment) Regulations 2001 and shall come into force on 1st May 2001.

Amendment of the Education (Adjudicators Inquiry Procedure etc.) Regulations 1999
    
2.  - (1) The Education (Adjudicators Inquiry Procedure etc.) Regulations 1999[3] shall be amended as follows.

    (2) In regulation 2 in the definition of "proposer" the word "and" after paragraph (b) shall be omitted and after paragraph (c) there shall be inserted the following - 

           " and

      (d) where the inquiry relates to proposals published under Part II of Schedule 7 to the Learning and Skills Act 2000[4], the Learning and Skills Council for England".

    (3) In regulation 2 for paragraph (d) of the definition of "relevant objector" there shall be substituted the following - 

      " (d) the Learning and Skills Council for England (if the inquiry is into any matter which affects education to which section 2(1) of the Learning and Skills Act 2000 applies); and".

    (4) In regulation 3(1) after sub-paragraph (b) there shall be added the following - 

           " or

      (c) arising from his consideration of proposals published under Part II of Schedule 7 to the Learning and Skills Act 2000 referred to him under paragraphs 35(5) or (6) or 37(1) or (2) of that Schedule".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Education (Adjudicators Inquiry Procedure etc.) Regulations 1999 in consequence of provisions in the Learning and Skills Act 2000.
