LORD JOHNSTON:
"We carefully considered the arguments advanced by the parties' representatives and concluded that it was not for this Tribunal to determine the date when the applicant became disabled. The issue for the Tribunal to decide is whether the applicant is disabled in terms of the Act: if she is, she may proceed to argue the merits of her claim; if she is not, then her claim cannot proceed."
"We were of the opinion that the Greenwood case made clear that the Tribunal must consider the situation as at the time of the hearing. We therefore asked ourselves the question – has the definition of "long term" been satisfied as at the 1st/2nd May 2002. The answer to that question is Yes, as the effect of the impairment has lasted at least 12 months."
