"We put you on notice. We will be faxing to you all statements upon which the Applicant intends to rely at the hearing at 4.30pm this afternoon. If you fail to provide us with all statements upon which you intend to rely at the hearing, we will ask the Tribunal to exclude all those statements as a consequence.
We would also point out that during your conversation with Simon Wysell this morning you confirmed there were no exceptional circumstances as to why your client was not in a position to exchange statements today. We will be drawing the Tribunal's attention to this letter at the hearing."
