- In this case we have come to the conclusion that there is an arguable point of law, that is to say whether in accordance with the relevant provisions of The Disability Discrimination Act 1995 the Applicant is entitled to bring a case in relation to post-dismissal acts of discrimination.
- That issue is a clearly important one which should go forward to a full hearing. A similar Order has already been made in the parallel case of Mrs D Angel -v- New Possibilities NHS Trust - that was made on 19 October 2000. In that Order His Honour Judge Reid indicated that it would be best to hold an inter partes directions hearing at a date to be fixed so that consideration could be given as to how best to bring that appeal into line with the existing appeal in Kirker, and indeed, any other cases raising the same point that there may be. We therefore direct, in accordance with that suggestion that this matter be listed together with the case of Angel, for an inter partes meeting for directions to consider how far this appeal should be linked to that of Angel.
- We observe, but we do not make a direction, that in so far as the Registry is in a position to draw to our attention other pending cases raising the same issue, it is of course convenient if those cases can also be considered at the same time. Subject to that, this case is likely to be a category B case, skeleton arguments need to be exchanged in the normal way and it is probably premature to give an indication as to the time necessary for the hearing until after the directions meeting has taken place.
