JUDGE LEVY: In this matter we have the benefit of Ms Hogg appearing for the Appellant under the ELAAS scheme, as so very often this has been of great assistance to us in hearing the PHD. Having heard from Ms Hogg, we are satisfied that there is a case to be go forward on this appeal, more or less as provided in Mr Brennan's letter to the Tribunal accompanying his Notice of Appeal.
- However, we would ask Ms Hogg to assist the Appellant in substituting a Notice of Appeal setting out for the ground 6, and that is in a form which will be easier for the Tribunal to follow. We consider this should be category C, estimated time of hearing half a day. If by the time this appeal is heard, there has been a decision on quantum in the parallel case, which is being heard at London North in the complaint by Mr Fenton against the same Respondents to the appeal, and no doubt the result of that case will be drawn to the attention of the Employment Appeal Tribunal hearing to this appeal in due course.
