JUDGE PETER CLARK: In this appeal EAT/287/99 the Appellant, Aintree Hospital NHS Trust, appeals against a decision of the Liverpool Employment Tribunal in which, among other things, that Tribunal found that in relation to certain catering staff initially employed by the Trust at their Walton Hospital there had been a relevant transfer of those employees to RCO Support Services Ltd, when the catering facility at Walton was closed down and a new catering facility opened at the nearby hospital at Fazakerley.
We need say no more about this appeal because in a related appeal EAT/38/99 brought by RCO Support Services Ltd against that same Tribunal decision, an order was made by a division of this Tribunal presided over by Judge Levy QC on 12 March 1999, that the RCO appeal be consolidated with this appeal by Aintree Hospital's NHS Trust and that the consolidated appeals be listed for a full appeal hearing with a one and a half day listing, Category A.
In these circumstances, that order having been made, we see no reason to interfere with it and accordingly the present appeal will proceed to a full hearing consolidated with appeal No. EAT/38/99 to be listed as originally directed by Judge Levy's Tribunal.
