JUDGE H WILSON: This is a preliminary hearing concering a decision promulgated by the Employment Tribunal on 22 September 1998 and containing Extended Reasons for the finding of unfair dismissal with an element of contribution. We have had the advantage of the grounds of appeal, Notice of Appeal dated 27 October 1998 and Mr Hillier has amplified the skeleton argument which was submitted on 21 January 1999.
In our view, this matter should proceed to a full hearing and we formulate the limits of the full hearings, what the Appellant should direct his arguments toward is the question, whether the Employment Tribunal fundamentally misdirected itself in holding that the dismissal was unfair for the reasons it given in the Extended Reasons. We think that that covers the real issue and we think it should be category C, an hour.
