JUDGE PETER CLARK: The question of law raised in this appeal is whether the provisions of the Race Relations Act 1976 cover the Applicant's complaint of unlawful racial discrimination arising out of his unsuccessful application to become a member of the Police Complaints Authority. An Employment Tribunal sitting at London (South) held that it did not. Against that decision the Applicant now appeals.
It is common ground between the parties that the appeal raises an arguable point of law. We agree. The appeal will proceed to a full hearing as presently constituted.
For that purpose we shall give the following directions. The case is to be listed for 1 full day. It should be marked for hearing by the President unless he expressly releases it. There will be exchange of skeleton arguments between the parties and copies lodged with this Tribunal not less than 14 days before the date fixed for the full appeal hearing. There are no further directions.
