JUDGE D M LEVY QC: This is an appeal by employers against a decision of an Employment Tribunal sitting at Stratford where a Chairman, sitting alone, held that the employer was to pay the Applicant the sum of £484.61 for wages deducted.
The issue was whether the employee had been given a guaranteed wage. For reasons given in the Extended Reasons, the Chairman decided that there was such an obligation. From that decision the employee appealed by a Notice of Appeal dated 1 December 1998 alleging that no reasonable Chairman could have come to the decision which that Chairman had.
Having looked at the four corners of the decision, we are of the opinion that on the Extended Reasons set out therein, a reasonable Chairman could have come to such a decision. The employers had a day in court and they lost. No matter of law arises on this appeal. We therefore dismiss it at this stage.
We should add that Mr Angel and Mr Jackson have written saying that they were unable to attend today. We are satisfied that if we had adjourned this PHD for them to attend on a future occasion, the result would have been the same.
