JUDGE PETER CLARK: This appeal, against the decision of the London (North) Industrial Tribunal chaired by Mr B.T. Charlton promulgated on 14 July 1997, came before a division of the EAT presided over by me for preliminary hearing on 17 November 1997.
On that occasion we adjourned the preliminary hearing in order to obtain the Chairman's notes of evidence in relation to an allegation in paragraph 9 of the Notice of Appeal that there was no evidence to support a material finding of fact contained in paragraph 6 of the Tribunal's extended reasons.
Having obtained the relevant notes of evidence and the Chairman's comments on that ground of appeal, the Appellant's Solicitors by letter to the Registrar dated 10 February 1998, accept that the evidence recorded by the Chairman does not support the contentions set out in the Notice of Appeal.
In these circumstances, there being no other point of law raised in the appeal, it must be dismissed.
