MR JUSTICE MORISON (PRESIDENT): Nobody has turned up for this appeal which has been listed for disposal.
It has become apparent from correspondence passing between Messrs Marsden Huck, solicitors for the appellant, and the Employment Appeal Tribunal, that Legal Aid had been removed from the appellant in this case. As a result of which they were no longer instructed in the matter and had no knowledge or instructions from their former client. The matter, therefore, has not been progressed for some time.
We have tried to contact the appellant but without success.
Accordingly, this is an appeal which is stale. We had given leave on 5th October 1995 for it to proceed to a full hearing. But as I say, nothing has happened. Accordingly, the right order is that the appeal should be dismissed.
