PRELIMINARY HEARING
For the Appellants | MR D McCARTHY LEGAL DEPT 16 PALACE STREET VICTORIA LONDON SW1E 5JD |
MR JUSTICE LINDSAY:
The question is, what assistance we need by way of Chairman's Notes or Chairman's comments? What do you say as to that?
Counsel: I imagine the Chairman's notes would be useful Sir, in relation to .....
Judge: How long did the hearing last?
Counsel: The hearing lasted for, I think, two days Sir.
Judge: It is only listed for as one day.
On balance, we think it is easier here to have all the Chairman's Notes rather than trying to limit the subject, but also it will be appropriate that the Chairman shall see your Notice of Appeal and be asked to comment on paragraph 6 of that, which is the grounds for the appeal, so that you will be inviting the Chairman not only to supply his notes, but also to make comment and thereafter, when you see the comments, it might be that the parties wish to further directions to take the matter further but we cannot really anticipate that.
So at this stage we simply say: Full hearing, Chairman's Notes and Chairman's comments on the paragraph 6 in the Notice of Appeal.
