MR JUSTICE MORISON (PRESIDENT): This is a somewhat strange matter. There was a preliminary hearing in this case to review the Notice of Appeal which had been filed with us, to determine whether there was an arguable point of law. As I understand the position, it was considered that there was an arguable point of law only in relation to an order for costs which had been made, and accordingly this has been listed for a full hearing.
However, curiously, the prospective Appellant is not of the view that there is any pending appeal before this Court. He regards the matter as being closed. We therefore are in the position of having on our files an appeal where the Appellant is of the view that no such appeal is in existence.
In those circumstances, it seems to us that the right course for us to take is to treat Mr Danquah as having withdrawn any such appeal as there may have been in this case and to dismiss his appeal on withdrawal.
