MR JUSTICE MUMMERY (PRESIDENT): This is an appeal against the decision of the Industrial Tribunal held at Liverpool over many days in May, June, July and August 1994. The Tribunal unanimously decided that Mr DeGale's claim for racial discrimination succeeded against the Merseyside Probation Committee and adjourned the question of compensation to a date to be fixed. The Extended Reasons for their unanimous decision were sent to the parties on 7 October 1994. An appeal against the decision was served by the Merseyside Probation Committee on 16 November 1994. Since then there have been negotiations between the parties and, fortunately for all concerned, an agreement has been reached settling the case.
We were notified by letter from the solicitors that no-one will be appearing today. They ask us to grant leave for the appeal to be withdrawn and to make an order dismissing it. That is the order we make. The appeal is dismissed.
