MR JUSTICE MUMMERY (PRESIDENT): This is the Preliminary Hearing of an appeal by Mr G Boateng against The Science Museum. He made a claim for unfair dismissal which failed before the Industrial Tribunal held at London (North) on 11 January 1994.
Mr Boateng appealed by Notice of Appeal dated 31 March 1994. Today was fixed as the date of the hearing after a number of earlier adjournments made at his request. When the appeal was called on this morning Mr Boateng did not attend. We had received a letter from the Citizens Advice Bureau in Walworth Road to say that they were no longer representing him. We caused enquiries to be made as to the possible reason for Mr Boateng's non-attendance, because it appeared from the file that he had every intention of pursuing his appeal.
We have now discovered that the letter sent to him informing him that the appeal would be heard today was sent to the address which he had entered in his IT.1, not to the different address entered on the Notice of Appeal. We have caused enquiries to be made from the Citizens Advice Bureau by telephone and it does indeed appear that he has changed address. The result is that the notification for today's hearing has gone to the wrong address. In those circumstances it would not be right to deal with the matter in his absence.
This appeal is therefore adjourned to be re-fixed at a date convenient to Mr Boateng.
