MR JUSTICE MORISON: This is a Preliminary Hearing in the case of Mr E A Marshall and The Royal London Hospital Trust. He has made complaints of racial discrimination in relation to his employment and a number of matters were investigated by the Industrial Tribunal who entered their decision in the register on 23 April 1993 following a hearing which spanned 7 days.
It is our view that there are matters which can legitimately be argued on this appeal and accordingly we would allow this to go for a Full Hearing before the Employment Appeal Tribunal. That said, we think it would be of assistance to this Court were the Appellant to be represented because there are issues of law which may require to be investigated. We understand that mention has already been made of the possibility of him having a solicitor and in any event we would have thought that it might be appropriate, if those arrangements have not been put in hand by the Appellant, that he perhaps could seek the advice of the Commission for Racial Equality as to possible representation. We do not consider that the Notes of Evidence are required as at present advised.
