MR JUSTICE WOOD (PRESIDENT): We have looked at this case and we propose to send it forward for a Full Hearing because in fact, although I am afraid it may cost TESCO some money, it raises some very interesting but difficult points.
As Mrs Douglas may or may not be "In Person" and whether or not TESCO are going to instruct Counsel, which speaking personally, I would be grateful if they would, because it is a very difficult one but it is a matter for them, but we are going to ask the Treasury Solicitor to brief someone as an Amicus because it seems to us that there is a very important point on limitation of time in all these European cases.
Once the Treasury Solicitor is in, if you will leave your name and address with the Court we will ask him or her to liaise with you on that matter.
So this will go forward. We will ask for an Amicus; we will ask too for the Notes of Evidence; any documentation that was before the Tribunal; liberty to apply; provisional estimate of length, two days and we will put that in the "fast lane" because I think it is an important point.
