      PUBLIC HEALTH

      CONTAMINATION OF FOOD

      The Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Partial Revocation Order 2001

        Made 16th January 2001 
        Laid before the Scottish Parliament 18th January 2001 
        Coming into force in accordance with article 1

      The Scottish Ministers, in exercise of the powers conferred by section 1(1) and (2) and section 24(3) of the Food and Environment Protection Act 1985[1], and of all other powers enabling them in that behalf, hereby make the following Order:

      Citation and commencement
           1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Partial Revocation Order 2001 and shall come into force at 1700 hours on 16th January 2001.

      Interpretation
          
      2. In this Order "the principal Order" means the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Order 2000[2].

      Partial Revocation of the principal Order
           3. The principal Order is revoked insofar as it designates-

        (a) any part of Area A described in the Schedule to this Order being an area within Area 1 described in the Schedule to the principal Order; and

        (b) any part of Area B described in the Schedule to this Order being an area within Area 3 described in the Schedule to the principal Order.

      SCHEDULE


      AREA A

      The area of sea below high water spings enclosed by a line starting at 56°45' North latitude 6°30' West longitude; then north to a point at 57°North latitude 6°30' West longitude; then east to a point on the west coast of Rhum at 57°North latitude 6°26.6' West longitude; then south, east and north along the shore to a point on the east coast of Rhum at 57°North latitude 6°14.5West longitude; then east to a point at 57°North latitude 6°West longitude; then south to a point on the mainland at 56°46.1' North latitude 6°West longitude; then west along the mainland shore to a point at 56°45' North latitude 6°11.4' West longitude; then west to the point of beginning.



      AREA B

      The area of sea below high water springs enclosed by a line starting at 55°30' North latitude 6°30' West longitude; then north to Port Wemyss on Islay at 55°40.5' North latitude 6°30' West longitude; then east and north along the southern shore of Islay to a point at 55°45' North latitude 6°02.8' West longitude; then east to a point at 55°45' North latitude 6°West longitude; then south to a point at 55°30' North latitude 6°West longitude then west to the point of beginning.

      EXPLANATORY NOTE

      (This note is not part of the Order)

      This Order is the sixth partial revocation of the Food Protection (Emergency Prohibitions) (Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Order 2000 ("the principal Order") which prohibited-

        (a) fishing for or taking scallops within the areas designated in the Schedule to that Order (article 4 of the principal Order);

        (b) movement of such scallops out of those areas (article 5 of the principal Order); and

        (c) landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such scallops from the designated areas (article 6 of the principal Order).

      The effect of this Order is to remove the prohibitions in respect of the areas of sea designated in the Schedule to this Order. Area A forms part of the area of sea designated as Area 1 in the Schedule to the principal Order. Area B forms part of the area of sea designated as Area 3 in the Schedule to the principal Order and there are therefore no remaining prohibitions in respect of the area of sea designated as Area 3 in the Schedule to the principal Order.
