Means of escape in case of fire certification by fire authority. 41.(1) Subject to subsection (2), premises shall not be used as a factory to which this section applies unless there is in force with respect to the premises a certificate of the fire authority that the premises are provided with such means of escape in case of fire for the persons employed in the factory as may reasonably be required in the circumstances of the case. (2) Where an application to certify any premises under this section is made in the prescribed form to the fire authority and, if regulations made by the Ministry so require, the application is accompanied by such plans as may be prescribed in the regulations, subsection (1) shall not apply to the use of the premises after the making of the application and before the grant or refusal of the certificate. (3) If any premises are used in contravention of this section the occupier shall be guilty of an offence and liable to a fine not exceeding two hundred pounds and, if the contravention is continued after conviction, he shall ... be guilty of a further offence and liable to a fine not exceeding twenty pounds for each day on which the contravention is so continued. (4) Where on the making of an application for a certificate under this section the fire authority [informs] the applicant that [it] will not grant the certificate unless specified alterations are made to the premises [it] shall specify the time within which the alterations are to be carried out and, if the certificate is not granted it shall be deemed to have been refused at the expiration of the time so specified or such further time as the authority may have allowed. (5) The fire authority shall examine every factory to which this section applies and, on being satisfied that it is provided with such means of escape as is mentioned in subsection (1), give a certificate under this section. (6) The certificate shall specify precisely and in detail the means of escape provided and shall contain particulars as to the maximum number of persons employed or proposed to be employed in the factory as a whole and, if the fire authority [thinks] fit, in any specified part thereof, and as to any explosive or highly inflammable material stored or used and as to other matters taken into account in granting the certificate. (7) The certificate shall be attached by the occupier to the general register and a copy of it shall be sent by the fire authority to the chief inspector.
