CHILDREN AND YOUNG PERSONS ACT (NORTHERN IRELAND) 1968 - SECT 31



31.(1) The succeeding provisions of this section shall have effect with
respect to such of the offences mentioned in Schedule 1 as are not arrestable
offences within the meaning of the Criminal Law Act (Northern Ireland) 1967.

(2) A constable may arrest without warrant any person who is, or whom he, with
reasonable cause, suspects to be, about to commit an offence to which
subsection (1) applies.

(3) Where a constable, with reasonable cause, suspects that an offence to
which subsection (1) applies has been committed, he may arrest without warrant
any person whom he, with reasonable cause, suspects to be guilty of the
offence, if he has reasonable ground for believing that that person will
abscond or if he does not know and cannot ascertain that person's name and
place of residence.

(4) For the purpose of arresting a person under any power conferred by this
section a constable may enter (if need be, by force) and search any place
where that person is or where the constable, with reasonable cause, suspects
him to be.

(5) Where a constable arrests any person without warrant for an offence to
which subsection (1) applies, the member of the Royal Ulster Constabulary in
charge of the constabulary station to which the person is brought (in this
section referred to as "the officer"), shall, unless in his belief the release
on bail of the person arrested would tend to defeat the ends of justice, or to
cause injury or danger to the child or young person against whom the offence
is alleged to have been committed, release the person arrested on his entering
into such a recognizance, with or without sureties, as may in the judgment of
the officer be required to secure his attendance upon the hearing of the
charge.

(6) Any such recognizance as aforesaid may be enforced in the same manner as a
recognizance to appear before a court may be enforced under the provisions of
section 138 of the Magistrates' Courts Act (Northern Ireland) 1964.
