Exemption of certain persons and institutions from the provisions of Part I, and definition of ""child''. 19.(1) The provisions of this Part shall not extend (a)to any relative or legal guardian of a child who undertakes the care and maintenance of the child; (b)to any school; or to any nursery school under the management of or assisted by a local education authority; (c)to any hospital; or to any other institution maintained under or by virtue of any provision of the [Health and Personal Social Services (Northern Ireland) Order 1972]; (d)to any institution established for the protection and care and maintenance of children and conducted in good faith for religious, philanthropic or charitable purposes, but only in so far as children are received and maintained therein. (2) Without prejudice to section 10(1), for the purposes of this Part "child" means a person who has not attained the upper limit of compulsory school age. Cruelty to persons under sixteen.
