8.(1) A tenant under a tenancy to which this Part applies may apply to the Lands Tribunal for the grant of a new tenancy (a)where the landlord has served a notice to determine the tenancy in accordance with section 4; or (b)where the tenant has made a request for a new tenancy in accordance with section 5. (2) An application made in consequence of a notice to detemine served by the landlord under section 4 shall not be entertained by the Lands Tribunal unless the tenant has notified the landlord that he will not be willing at the date of termination to give up possession of the property comprised in the tenancy. (3) An application under this section shall not be entertained by the Lands Tribunal unless it is made not less than two nor more than four months (or with the written consent of the landlord within such longer period as the landlord may specify) after the service of the landlord's notice to determine under section 4, or as the case may be, after the making of the tenant's request for a new tenancy under section 5.
