112.(1) Any person who (a)by false representation or imposition obtains possession of any moneys, securities, books, papers or other effects of a building society; or (b)having any such moneys, securities, books, papers or other effects in his possession, withholds or misapplies them, or wilfully applies any part of them to purposes other than authorised purposes; (2) A person guilty of an offence under this section shall be liable (a)on conviction on indictment, to a fine, or to imprisonment for a term not exceeding two years, or to both; and (b)on summary conviction, to a fine not exceeding two hundred pounds, or to imprisonment for a term not exceeding three months, or to both. (3) The court by or before which a person is convicted of an offence under this section may order him to deliver up or repay to the building society any moneys, securities, books, papers or other effects in respect of which he is convicted of that offence. (4) Proceedings in respect of an offence under this section in relation to a building society may be instituted by the society, the registrar or the Attorney General; but such proceedings shall not be instituted by any other person unless he is a member of the society authorised in that behalf by the society or by the board of directors of the society or by the registrar. (5) In this section "authorised purposes", in relation to a building society, means purposes authorised by the rules of the society or by this Act.
