The Welsh Ministers make the following Regulatipons in exercise of the powers conferred on them by section 90(2) of the Coronavirus Act 2020( 1).
1.—(1) The title of these Regulations is the Coronavirus Act 2020 (Alteration of Expiry Date) (Wales) Regulations 2022.
(2) These Regulations come into force on 23 March 2022.
2.—(1) The provisions of the Coronavirus Act 2020 specified in paragraph (2)—
(a) do not expire at the time when they would otherwise expire by virtue of section 89 of the Act, and
(b) expire instead at the end of the day on 24 September 2022.
(2) The provisions are—
(a) section 38(1), in so far as it applies in relation to Wales;
(b) section 82, in so far as it applies in relation to Wales;
(c) in Part 1 of Schedule 17—
(i) paragraph 2;
(ii) paragraph 3, in so far as it applies in relation to Wales;
(iii) paragraph 4, in so far as it applies in relation to Wales;
(iv) paragraph 7;
(v) paragraph 8.

Section 89(1) of the Coronavirus Act 2020 provides that the Act expires at the end of the period of 2 years beginning with the day on which it is passed, subject to subsection (2) of that section and section 90 of the Act.
Section 90(2) of the Act provides that a relevant national authority may, by regulations, provide that any provision of the Act does not expire at the time when it would otherwise expire and expires instead at such later time as is specified in the regulations. The Welsh Ministers are a relevant national authority for Wales in relation to provisions of the Coronavirus Act 2020 that apply in relation to Wales and which would fall within the legislative competence of Senedd Cymru.
These Regulations extend the expiry date of certain provisions of the Coronavirus Act 2020 to the end of the day on 24 September 2022. They would otherwise expire at the end of the day on 24 March 2022, as provided for by section 89 of that Act.
No impact assessment has been prepared for this instrument.
2020 c. 7. The power to make regulations under section 90(2) of the Act is conferred on “a relevant national authority”. Under section 90(7) of the Act, the Welsh Ministers are a relevant national authority in relation to the power to extend the expiry date of a provision of the Act that extends to England and Wales and applies in relation to Wales, and which would be within the legislative competence of Senedd Cymru if it were contained in an Act of Senedd Cymru (including any provision that could only be made with the consent of a Minister of the Crown within the meaning of the Ministers of the Crown Act 1975).
