This Order is made by the Welsh Ministers(1) in exercise of the powers conferred on the National Assembly for Wales by paragraph 8(1) of Schedule 8 and paragraph 3(1) of Schedule 10 to the Traffic Management Act 2004(2).
Monmouthshire County Council has applied to the Welsh Ministers for an Order to be made under these powers in respect of part of that Council's area.
The Welsh Ministers have consulted the chief officer of Gwent Police in accordance with the requirements of paragraph 8(3) of Schedule 8 and paragraph 3(4) of Schedule 10 to the Traffic Management Act 2004.
1. The title of this Order is the Civil Enforcement of Parking Contraventions (County of Monmouthshire) Designation Order 2019 and it comes into force on 8 April 2019.
2. The Welsh Ministers designate the area described in the Schedule to this Order as-
(a)a civil enforcement area for parking contraventions; and
(b)a special enforcement area.

Article 2
The area of the County of Monmouthshire ("the County") with the exception of-
(a)the length of the M4 Motorway within the County, from the boundary with the City of Newport to the boundary at the Prince of Wales Bridge, including its exit and entry slip roads;
(b)the length of the M48 Motorway within the County, from its junction with the M4 Motorway to the boundary at the Wye Bridge, including its exit and entry slip roads;
(c)the length of the A40 Trunk Road within the County, from its junction with the A465 Trunk Road to the boundary with the County of Powys and from its junction with the A465 Trunk Road to the boundary with the County of Herefordshire, including its exit and entry slip roads;
(d)the length of the A465 Trunk Road within the County, from its junction with the A40 Trunk Road to the boundary with the County Borough of Blaenau Gwent and from its junction with the A40 Trunk Road to the boundary with the County of Herefordshire, including its exit and entry slip roads;
(e)the length of the A449 Trunk Road within the County, from the boundary with the City of Newport to its junction with the A40 Trunk Road, including its exit and entry slip roads;
(f)the length of the A4042 Trunk Road within the County, from the boundary with the County Borough of Torfaen to its junction with the A465 Trunk Road;
(g)the length of the A466 Trunk Road within the County, from its junction with the M48 motorway to its junction with A48 Trunk Road; and
(h)the length of the A48 Trunk Road within the County, from its junction with the A466 Trunk Road to the boundary with the County of Gloucestershire.

This Order designates the area described in the Schedule to this Order as a civil enforcement area for parking contraventions and a special enforcement area for the purposes of Part 6 of the Traffic Management Act 2004. This Order enables Monmouthshire County Council to enforce parking contraventions within the area described in the Schedule to this Order through a civil law regime, as opposed to enforcement by police or traffic wardens in a criminal law context.

By virtue of section 92 of the Traffic Management Act 2004, the National Assembly for Wales was designated as the appropriate national authority as regards Wales, for the purposes of Part 6 of that Act. The functions of the National Assembly for Wales under the Traffic Management Act 2004 were transferred to the Welsh Ministers by virtue of section 162 of, and paragraph 30 of Schedule 11 to, the Government of Wales Act 2006 (c. 32)..
