The Welsh Ministers in exercise of their powers in sections 8(10)(b) and 20(1) and (2) of the Human Transplantation (Wales) Act 2013(1) and having carried out such public consultation as they consider appropriate in accordance with section 20(3) of that Act make the following Regulations.
In accordance with section 20(4) of that Act, a draft of these Regulations has been laid before and approved by a resolution of the National Assembly for Wales.
1.-(1) The title of these Regulations is the Human Transplantation (Appointed Representatives) (Wales) Regulations 2015 and they come into force at 00:01 on 1 December 2015.
(2) These Regulations apply in relation to Wales.
2. For the purpose of providing express consent under section 3 of the Act, a person may not act under appointment if that person lacks capacity to understand the notion of consenting to a transplantation activity.

These Regulations are made under the Human Transplantation (Wales) Act 2013 ("the Act") (2013 anaw 5).
These Regulations make provision as to the description of persons who may not act as an appointed person for the purposes of the Act.
The Welsh Ministers' Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations. A copy can be obtained at the Department of Health and Social Services, Welsh Government, Cathays Park, Cardiff CF10 3NQ.
