This Order is made in exercise of the powers conferred on the Secretary of State by sections 16(1)(a) and 17 of the Further and Higher Education Act 1992(1) and now exercisable by the Welsh Ministers(2).
The Welsh Ministers have published a draft and summary of this Order in accordance with section 16A of the Further and Higher Education Act 1992 and the Further Education Corporations (Publication of Draft Orders) (Wales) Regulations 2007(3).
Accordingly, the Welsh Ministers make the following Order:
1. The title of this Order is the Coleg Cambria (Incorporation) Order 2013 and it comes into force on 26 March 2013.
2. On 26 March 2013 a body corporate called Coleg Cambria is to be established, for the purpose of establishing and conducting from the operative date an educational institution of the same name.
3. The operative date appointed in relation to Coleg Cambria is 1 August 2013, and the corporation is to conduct the educational institution of Coleg Cambria from that date.

This Order establishes a further education corporation called "Coleg Cambria" under section 16(1)(a) of the Further and Higher Education Act 1992 ("the Act") for the purpose of conducting the educational institution of the same name. The Order also provides for the appointment of 1 August 2013 as the operative date for the purposes of Part 1 of the Act, being the date from which Coleg Cambria is to conduct the educational institution of the same name.
A draft and summary of this Order have been published in accordance with section 16A of the Act and the Further Education Corporations (Publication of Draft Orders) (Wales) Regulations 2007.
1992 c. 13; section 16 of the Further and Higher Education Act 1992 was amended by section 140(3) of and Schedule 31 to the Schools Standards and Framework Act 1998 (c. 31); by section 111(1) of the Learning and Skills Act 2000 (c. 21) and by the Local Education Authorities and Children's Services Authorities (Integration of Functions) Order 2010 (S.I. 2010/1158). Section 17 of the Further and Higher Education Act 1992 was amended by paragraph 7 of Schedule 3 to the Teaching and Higher Education Act 1998 (c. 30) and by paragraphs 1 and 2 of Schedule 8 to the Apprenticeships, Skills, Children and Learning Act 2009 (c. 22).
The functions of the Secretary of State under sections 16(1)(a) and 17 of the Further and Higher Education Act 1992 were transferred to the National Assembly for Wales by virtue of article 2 of and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672). The functions of the National Assembly for Wales were subsequently transferred to the Welsh Ministers by virtue of paragraph 30 of Schedule 11 to the Government of Wales Act 2006 (c. 32).
