The Welsh Ministers make the following Regulations in exercise of the powers conferred by section 2(2) of, and paragraph 1A of Schedule 2 to, the European Communities Act 1972(1).
The Welsh Ministers are designated for the purposes of that section in relation to measures relating to food (including drink) including the primary production of food(2).
1.–(1) The title of these Regulations is The Meat (Official Controls Charges) (Wales) (Amendment) Regulations 2010.
(2) These Regulations apply in relation to Wales.
(3) These Regulations come into force on 25 May 2010.
2. In these Regulations, "the Principal Regulations" ("y Prif Reoliadau") means The Meat (Official Controls Charges) (Wales) Regulations 2009(3).
3.–(1) The Principal Regulations are amended in accordance with the following paragraphs of this regulation.
(2) In the third paragraph of the preamble–
(a) in the English text for "to the Secretary of State" substitute "to the Welsh Ministers";
and
(b) in the Welsh text for "i'r Ysgrifennydd Gwladol" substitute "i Weinidogion Cymru".
(3) In regulation 2(1) (interpretation) in the Welsh text, for the definition which begins "mae i "Cyfarwyddeb 2004/41"" and ends with "yn ôl eu trefn yn Atodlen 1;" substitute

(a) in the English text in both places where the word "secretary" occurs substitute "Secretary"; and
(b) in the Welsh text in both places where they occur for the words "ysgrifennydd neu ysgrifenyddes" substitute "Ysgrifennydd".

The Meat (Official Controls Charges) (Wales) Regulations 2009 (S.I. 2009/1557 (W.152)) ("the Principal Regulations") revoke and replace the Meat (Official Controls Charges) (Wales) Regulations 2008 (S.I. 2008/601 (W.63)).
The Principal Regulations provide for the execution and enforcement in relation to Wales of Articles 26 and 27 of Regulation (EC) No. 882/2004 concerned with feed and food law, animal health and animal welfare, in so far as the provisions require or permit fees to be collected to cover the costs occasioned by official controls in relation to certain types of poultry; animal welfare in slaughterhouses; slaughter of animals outside slaughterhouses and the slaughter of poultry and various other farmed animals on farms. The Principal Regulations make further provision in relation to notification to operators of any requirement to pay fees or supply information, and in relation to calculation of the official controls charge.
These Regulations make minor amendments to the preamble, and regulations 2(1) and 5(2)(b), of the Principal Regulations.

S.I. 2005/1971. By virtue of section 162 of, and paragraphs 28 and 30 of Schedule 11 to, the Government of Wales Act 2006, functions conferred on the National Assembly for Wales by this designation are exercisable by the Welsh Ministers. Back [2]
