Coming into force in accordance with regulation 1
1.–(1) The title of these Regulations is the Assembly Learning Grants (European Institutions) (Wales) (Amendment) Regulations 2009.
(2) Subject to paragraph (3) these Regulations come into force on 1 September 2009.
(3) Regulations 8 and 9 come into force on 31 August 2009.
2. In these Regulations–
"the Amendment Regulations" ("y Rheoliadau Diwygio") means the Assembly Learning Grants (European Institutions) (Wales) (Amendment) (No.2) Regulations 2008(3); and
"the Principal Regulations" ("y Prif Reoliadau") means the Assembly Learning Grants (European Institutions) (Wales) Regulations 2008(4).
3. The Principal Regulations are amended in accordance with Regulations 4 to 7.
4. In regulation 18(3), for "27,115 euro" substitute "28,200 euro".
5. In regulation 19(3), for "11,090 euro" substitute "13,450 euro".
6. In regulation 20(3)–
(a) for "A is £2,402" substitute "A is £2,463"; and
(b) for "B is £49", substitute "B is £50".
7. In regulation 20(5), for "B is £99", substitute "B is £102".
8. The Amendment Regulations are amended in accordance with regulation 9.
9. In the Welsh text of regulation 7(2), for "17,640 ewro", substitute "18,099 ewro".

These Regulations amend the Assembly Learning Grants (European Institutions) (Wales) Regulations 2008 ("the Principal Regulations").
The Principal Regulations provide for support for eligible students taking designated higher education courses at the Bologna Center, the College of Europe or the European University Institute.
The Principal Regulations provide that a grant for fees is available for one eligible student at the Bologna Center. A grant for fees, grants for living and other costs, a disabled students' allowance and a grant for dependants are available for up to two eligible students at the College of Europe. Grants for living and other costs, a disabled students' allowance and a grant for dependants are available for one eligible student at the European University Institute.
The Principal Regulations were amended by the Assembly Learning Grants (European Institutions) (Wales) (Amendment) (No. 2) Regulations 2008 in order that they apply in respect of an academic year beginning on or after 1 September 2009. These Regulations amend the amounts of certain support payable to students for an academic year beginning on or after 1 September 2009.
Regulation 4 amends the maximum amount of grant for fees payable to a Bologna Center student.
Regulation 5 amends the maximum amount of grant for fees payable to a College of Europe student.
Regulations 6 and 7 amend the figures used in calculating grant for living costs and grant for travel payable to a College of Europe student.
Regulations 8 and 9 correct a typographical error in the Welsh text of the Assembly Learning Grants (European Institutions) (Wales) (Amendment) (No. 2) Regulations 2008.

The functions of the Secretary of State under section 22 of the Teaching and Higher Education Act 1998 (except so far as they relate to the making of any provision authorised by subsection (2)(a), (c), (j) or (k), (3)(e) or (f) or (5) of section 22) were transferred to the National Assembly for Wales by section 44 of the Higher Education Act 2004 and the Higher Education Act 2004 (Commencement No. 2 and Transitional Provision) (Wales) Order 2005 (S.I. 2005/1833 (W.149) (C.79)) as amended by the Higher Education Act 2004 (Commencement No. 2 and Transitional Provision) (Wales) (Amendment) Order 2006 (S.I. 2006/1660 (W.159) (C.56)) refers. The functions of the National Assembly for Wales were transferred to the Welsh Ministers by virtue of paragraphs 30(1) and 30(2)(a) of Schedule 11 to the Government of Wales Act 2006 (c. 32).
