The Welsh Ministers, in exercise of the powers conferred upon them by sections 40 and 44(3) and (5) of the Children and Young Persons Act 2008(1), make the following Order:
1.–(1) The title of this order is the Children and Young Persons Act 2008 (Commencement No. 2) (Wales) Order 2009.
(2) In this Order "the Act" ("y deddf") means the Children and Young Persons Act 2008.
(3) This Order applies in relation to Wales.
2. 1 September 2009 is the appointed day for the coming into force of the following provisions of the Act–
(a) section 36 (entitlement of relative to apply for a residence order);
(b) section 37 (duration of residence orders);
(c) section 38 (entitlement of relative to apply for a special guardianship order); and
(d) section 42 and Schedule 4 (repeals) in so far as they relate to the repeal of section 12(5) and (6) and the repeal in part of section 91(10), of the Children Act 1989(2).

This Order brings into force on 1 September 2009 sections 36, 37, 38 and 42 of, and Schedule 4 to, the Children and Young Persons Act 2008, to the extent specified in the Order. The reference in Article 2(d) of the Order to the repeal in part of section 91(10) of the Children Act 1989, is a reference to the omission of the words "or 12(5)" from that section.
