Coming into force in accordance with regulation 1
1.–(1) The title of these Regulations is the Assembly Learning Grants (European Institutions) (Wales) (Amendment) (No. 2) Regulations 2008.
(2) Subject to paragraph (3) these Regulations come into force on 31 December 2008.
(3) Regulations 7 and 8 come into force on 1 September 2009.
(4) These Regulations apply in relation to Wales.
2. In these Regulations, "the Principal Regulations" ("y Prif Reoliadau") means the Assembly Learning Grants (European Institutions) (Wales) Regulations 2008(3).
3. The Principal Regulations are amended in accordance with these Regulations.
4.–(1) Regulation 3 is amended as follows.
(2) In the definition of "relevant date" ("dyddiad perthnasol"), for "1 February 2008", substitute "12 January 2009".
5.–(1) Regulation 9 is amended as follows.
(2) In paragraph (3)–
(a) for "1 September 2008", substitute "1 September 2009"; and
(b) for "28 February 2008" in each place it appears, substitute "1 February 2009".
6.–(1) Regulation 10 is amended as follows.
(2) For paragraph (17) substitute–
"(17) The deadline for receipt of financial information in relation to an academic year beginning on or after 1 September 2009 is 1 February 2009, or in the case of grants payable under regulations 20(7) and 22(6), 1 February 2010.".
7.–(1) Regulation 22 is amended as follows.
(2) For paragraph (3), substitute–
"(3) A European University Institute student qualifies for a grant for living costs of 18,099 euro in relation to an academic year beginning on or after 1 September 2009.".
8. The Schedule to these Regulations has effect to substitute the figures in the third column of the table for the figures in the second column of the table where they appear in the provisions of the Principal Regulations set out in the first column.
9. The Assembly Learning Grants (European Institutions) (Wales) (Amendment) Regulations(4) are amended in accordance with regulation 10.
10. In the Welsh text of regulation 3, omit "a Benthyciadau".

These Regulations amend the Assembly Learning Grants (European Institutions) (Wales) Regulations 2008 ("the Principal Regulations").
The Principal Regulations provide for support for eligible students taking designated higher education courses at the Bologna Center, the College of Europe or the European University Institute in respect of an academic year beginning on or after 1 September 2008.
The Principal Regulations provide that a grant for fees is available for one eligible student at the Bologna Center. A grant for fees, grants for living and other costs, a disabled students' allowance and a grant for dependants are available for up to two eligible students at the College of Europe. Grants for living and other costs, a disabled students' allowance and a grant for dependants are available for one eligible student at the European University Institute.
These Regulations amend the Principal Regulations in order that they apply in respect of an academic year beginning on or after 1 September 2009.
Regulations 5 and 6 amend the deadlines for applications for support and the receipt of financial information in relation to an academic year beginning on or after 1 September 2009.
Regulations 7 and 8 and the Schedule to these Regulations increase the amounts of support payable to eligible students and related income thresholds for an academic year beginning on or after 1 September 2009.
In addition, regulations 9 and 10 correct a typographical error in the Welsh text of the Assembly Learning Grants (European Institutions) (Wales) (Amendment) Regulations 2008.

The functions of the Secretary of State under section 22 of the Teaching and Higher Education Act 1998 (except so far as they relate to the making of any provision authorised by subsection (2)(a), (c), (j) or (k), (3)(e) or (f) or (5) of section 22) were transferred to the National Assembly for Wales by section 44 of the Higher Education Act 2004 and the Higher Education Act 2004 (Commencement No. 2 and Transitional Provision) (Wales) Order 2005 (S.I. 2005/1833 (W.149) (C.79)) as amended by the Higher Education Act 2004 (Commencement No. 2 and Transitional Provision) (Wales) (Amendment) Order 2006 (S.I. 2006/1660 (W.159) (C.56)) refers. The functions of the National Assembly for Wales were transferred to the Welsh Ministers by virtue of paragraphs 30(1) and 30(2)(a) of Schedule 11 to the Government of Wales Act 2006 (c. 32).
