Welsh Ministers make the following regulations in exercise of the powers conferred by sections 71, 76, 77, 128, 129, 203(9) and (10) of the National Health Service (Wales) Act 2006(1).
1. The title of these Regulations is the National Health Service (Optical Charges and Payments) and (General Ophthalmic Services) (Amendment) (Wales) Regulations 2008 which come into force on 28 March 2008.
2. In the definition of "NHS sight test fee" in regulation 1(2) of the National Health Service (Optical Charges and Payments) Regulations 1997(2) –
(a) for "£52.04" substitute "£53.34" and
(b) for "£18.85" substitute "£19.32".
3. In regulation 10(1) (the statement) of the National Health Service (General Ophthalmic Services) Regulations 1986(3) at the end of regulation 10(1)(b) for the words from "A determination" to "relates." substitute –
"A determination may provide that such fees and allowances may be paid in respect of a period beginning on a date earlier than the date of the determination if, taking the determination as a whole, it is not detrimental to the persons to whose remuneration it relates.".

These Regulations amend the National Health Service (Optical Charges and Payments) Regulations 1997 so as to make reference to an increase in the NHS sight test fees of 2.5%. The Regulations also amend regulation 10 of the National Health Service (General Ophthalmic Services) Regulations 1986 to provide that where Welsh Ministers make provision in a determination as to the fees to be paid by a Local Health Board for the testing of sight by ophthalmic medical practitioners and opticians, the determination may provide that the fees may be paid in respect of a period beginning on a date earlier than the date of the determination, if taking the determination as a whole, it is not detrimental to the persons to whose remuneration it relates.
