The National Assembly for Wales makes the following Regulations in exercise of the powers conferred by section 16(1), (1A), (3) and (4) of the Plant Varieties and Seeds Act 1964[
1] and now vested in it[
2].
In accordance with section 16(1) of that Act it has consulted with representatives of such interests as appear to it to be concerned.
Title, commencement and application
1.
—(1) The title of these Regulations is the Cereal Seed (Wales) and Fodder Plant Seed (Wales) (Amendment) Regulations 2006.
(2) These Regulations come into force on 20 December 2006.
(3) These Regulations apply in relation to Wales.
Amendment of the Cereal Seed (Wales) Regulations 2005

—(1) The Cereal Seed (Wales) Regulations 2005[
3] are amended as follows.
(2) In column 3 of the Table in Schedule 7 (lot and sample weights), for "25", wherever occurring, substitute "30".
Amendment of the Fodder Plant Seed (Wales) Regulations 2005

—(1) The Fodder Plant Seed (Wales) Regulations 2005[
4] are amended as follows.
(2) In regulation 23(3) (sampling), at the end, add—
(c) where more than 50% of the mixture consists of a species of seed for which the maximum weight of a seed lot prescribed in seed regulations is 30 tonnes, the maximum weight of the seed lot must be 30 tonnes.".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations implement Commission Directive 2006/55/EC of 12 June 2006 amending Annex III to Council Directive 66/402/EEC as regards the maximum weight of seed lots (O.J. No. L 159, 13.6.2006, p.13).
They amend the Cereal Seed (Wales) Regulations 2005 (S.I. 2005/3036 (W. 224)) to increase the maximum weight of a seed lot of species of cereal seed, except for maize, from 25 to 30 tonnes. They also make a consequential amendment to the Fodder Plant Seed (Wales) Regulations 2005 (S.I. 2005/1207 (W. 79)) to ensure that, where more than 50% of a seed lot comprising a mixture of fodder plant seed and seed for which the maximum weight of a seed lot is increased by these Regulations to 30 tonnes, the maximum weight of the mixed seed lot is also 30 tonnes.
