The National Assembly for Wales, in exercise of the powers conferred upon it by sections 25 (7), 104(1) and (4), paragraphs 4(1)(a) of Schedule 4, 7(1)(a) and (4) of Schedule 5, and 10(1)(a) of Schedule 6 to the Children Act 1989[
1] and of all other powers enabling it to do so, hereby makes the following regulations:
Title, commencement and application
1.
—(1) The title of these Regulations is the Children (Secure Accommodation) (Amendment) (Wales) Regulations 2006 and they will come into force on 16 November 2006.
(2) These Regulations apply in relation to Wales.
Amendment
2.
Regulation (3) of the Children (Secure Accommodation) Regulations 1991[
2] (Approval by Secretary of State of secure accommodation in a children's home) is revoked.
The powers are exercisable by the Secretary of State. In relation to Wales the functions are transferred to the National Assembly for Wales by Article 2 of, and the entry for the 1989 Act in Schedule 1, to the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672).

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Children (Secure Accommodation) Regulations 1991[
4] by revoking regulation 3 of those Regulations so far as it applies in Wales. This regulation provides that accomodation in a children's home in Wales is not to be used as secure accomodation unless it has been approved by the National Assembly for Wales for such use. The function of approving children's secure accomodation is exercisable by the Secretary of State and was transferred to the National Assembly for Wales in 1999[
