The National Assembly for Wales, being designated[
1] for the purposes of section 2(2) of the European Communities Act 1972[
2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by that section, makes the following Regulations:
Title, commencement and application
1.
These Regulations are called the Pig Carcase (Grading) (Amendment) (Wales) Regulations 2004; they apply to Wales only and come into force on 31st January 2004.
Amendment to the Pig Carcase (Grading) Regulations 1994

- (1) The Pig Carcase (Grading) Regulations 1994 [
3] are amended in accordance with this regulation.
(2) In regulation 2(1), there is substituted the following definition for the definition of "the Commission Decision" -
"
"the Commission Decision" means Commission Decision 88/234/EEC [4] authorising methods for grading pig carcases in the United Kingdom as amended by Commission Decision 88/478/EEC [5], Commission Decision 92/557/EEC[6], Commission Decision 93/445/EEC[7], Commission Decision 94/336/EEC[8] and Commission Decision 2003/750/EC[9].".

EXPLANATORY NOTE
(This note is not part of the Regulations)
These regulations, which apply to Wales only, are made under section 2(2) of the European Communities Act 1972 and amend the provisions of the Pig Carcase (Grading) Regulations 1994. Those regulations provide for the administration and enforcement of the Community system of grading pig carcases established by Council Regulation (EEC) No. 3220/84 (OJ No. L301, 20.11.84, p.1) as amended. The detailed rules are set out in Commission Regulation (EEC) No. 2976/85 (OJ No. L285, 25.10.85, p.39) and Commission Decision 88/234/EEC (OJ No. L105, 26.4.88, p.15), as amended.
These Regulations authorise a new method of grading the composition of pig carcases by using the apparatus known as "fully automatic ultrasonic carcass grading" ("AUTOFOM") and withdraw authorisation for use of the apparatus known as "Ultra-FOM". Use of AUTOFOM is in addition to the other methods specified in Commission Decision 88/234/EEC, as amended.
