The Rhondda Cynon Taff and Vale of Glamorgan (Llanharry, Pont-y-clun, Penllyn, Welsh St Donats and Pendoylan) Order 2002

The Local Government Boundary Commission for Wales, has submitted to the National Assembly for Wales in accordance with section 54(1) and 58(1) of the Local Government Act 1972[
1] a report dated March 2001 on its review of part of the areas of the County Boroughs of Rhondda Cynon Taff and the Vale of Glamorgan in the communities of Llanharry, Pont-y-clun, Penllyn, Welsh St Donats and Pendoylan together with the proposals they have formulated thereon;
and the National Assembly for Wales having decided to give effect to those proposals without modification;
and more than six weeks having elapsed since those proposals were made;
now the National Assembly for Wales, in exercise of the powers given to the Secretary of State by section 58(2) of the Local Government Act 1972 which are now vested in the National Assembly for Wales so far as exercisable in Wales[
2] makes the following Order:
Name and Commencement
1.
- (1) This Order is called the Rhondda Cynon Taff and Vale of Glamorgan (Llanharry, Pont-y-clun, Penllyn, Welsh St Donats and Pendoylan) Order 2002.
(2) This Order shall come into force on 6th April 2002, which is the appointed day for the purposes of the Regulations, except that for the purpose of all proceedings preliminary or relating to an election to be held on or after that date this Order shall come into force on the day after that on which it is made.
Interpretation

In this Order -
"the boundary map" ("y map ffiniau") means the map prepared by the National Assembly for Wales and marked "Map of the Rhondda Cynon Taff and Vale of Glamorgan (Llanharry, Pont-y-Clun, Penllyn, Welsh St Donats and Pendoylan) Order 2002" and deposited in accordance with Regulation 5 of the Regulations;
"the Regulations" ("y Rheoliadau") means the Local Government Area Changes Regulations 1976 as amended[3];
"Rhondda Cynon Taff" ("Rhondda Cynon Taf") means the County Borough of Rhondda Cynon Taff;
"the Vale of Glamorgan" ("Bro Morgannwg") means the County Borough of the Vale of Glamorgan.
Changes In Community Areas

The part of Rhondda Cynon Taff which is in the community of Llanharry and is shown cross-hatched in black on the boundary map shall be separated from that county borough and community and shall form part of the community of Penllyn in the Vale of Glamorgan.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order, made in accordance with section 58(2) of the Local Government Act 1972 gives effect to proposals by the Local Government Boundary Commission for Wales . The effect of those proposals is that an area of the community of Llanharry in Rhondda Cynon Taff in the vicinity of two properties known as "Brynderwen" and "Two Hoots" (shown cross-hatched in black on the boundary map referred to in Article 2 of the Order) become part of the community of Penllyn in the Vale of Glamorgan after this Order comes into force.
Prints of the boundary map are deposited and may be inspected during normal office hours at the offices of Rhondda Cynon Taff at The Pavilions, Cambrian Business Park, Clydach Vale, Tonypandy, Rhondda Cynon Taff and at the offices of the Vale of Glamorgan County Borough Council Civic Offices, Holton Road, Barry, Vale of Glamorgan and at the offices of the National Assembly for Wales at Cathays Park, Cardiff (Local Government Modernisation Division).
The Local Government Area Changes Regulations 1976 (as amended) referred to in Article 2 of this Order contain incidental, consequential, transitional and supplementary provision about the effect and implementation of orders such as this.
