EXPLANATORY NOTE
(This note is not part of the Order)
This Order appoints days for certain provisions of Part IV (social care workers) of the Care Standards Act 2000 ('the Act') to come into force. The provisions brought into force by this Order concern the training of social care workers in Wales.
31st July 2001 is the day appointed for the following provisions of the Act to come into force:
(a) Section 63, which allows the Care Council for Wales ('the Council') to approve certain social work courses in accordance with rules made by it;
(b) Section 66, which allows the Council to make provision by rules for the visiting of places where certain social work courses take place;
(c) Section 71, which makes provision about the nature of the rules that the Council may make. It also requires the consent of the Assembly before any rules of the Council may be made.
1st October 2001 is the day appointed for the following provisions of the Act to come into force:
(a) Section 67, which confers a number of functions upon the Assembly in relation to social care work training. It allows the Assembly to encourage persons to take part in courses for social care workers and to provide such courses. It also allows the Assembly to pay grants and other allowances to persons resident in Wales to secure their training in social care work. The Assembly may delegate its functions under this provision to the Council;
(b) Section 70(1), which provides for certain of the functions of the Central Council for Education and Training in Social Work ('CCETSW') to cease to be exercised in relation to Wales (the abolition of CCETSW is to be effected by an Order in Council of Her Majesty under Section 70(2) of the Act). The functions it is to cease exercising are similar to the functions conferred upon the Council and the Assembly by the other provisions brought into force by this Order.
