Must e-Signatures be reliable?
Abstract
John D. Gregory revisits and criticizes the statutory requirement that the validity of an electronic signature depends on its being as reliable as appropriate in the circumstances, because such a requirement unfairly discriminates against electronic signatures, and argues that the law should not impose a variable standard of prudence.
