The Secretary of State makes this Order in exercise of the powers conferred by section 8(2) of the Immigration Act 1971( 1).
1.—(1) This Order may be cited as the Immigration (Exemption from Control) (Amendment) Order 2025 and comes into force on 17th July 2025.
(2) This Order extends to England and Wales, Scotland and Northern Ireland.
2. In Article 4 of the Immigration (Exemption from Control) Order 1972( 2), after paragraph (ma) insert—
“(mb) any member of staff employed by the Taipei Representative Office in the United Kingdom where all the following sub-paragraphs apply:
(i) their employment is at the level of Representative, Deputy Representative, Director General, Deputy Director General, Director, Deputy Director, Senior Assistant Director, or Assistant Director,
(ii) they are employed in the capacity of a representative function,
(iii) they are not employed in the capacity of administrative, transportation, maintenance, service or other ancillary functions,
(iv) they are in the full-time employment of the Taipei Representative Office and are not engaged in the United Kingdom in any private occupation for gain, and
(v) they were resident outside the United Kingdom, and were not in the United Kingdom, when they were offered such employment. ”.

This Order amends the Immigration (Exemption from Control) Order 1972(“ the principal Order”), made undersection 8(2)of the Immigration Act 1971(“ the Act”).
Article 4of the principal Orderexempts specified classes of person from the provisions of the Actapplicable to those who are not British citizens, except any provision relating to deportation. This Order amendsArticle 4of the principal Orderto add new specified classes of person, namely eligible employees of the Taipei Representative Office and their family members.
A full impact assessment has not been produced for this instrument as no, or no significant, impact on the private, voluntary or public sector is foreseen.
