The Secretary of State makes the following Regulations in exercise of the powers conferred by section 41(1), (2)(k)(ii) and (5) of the Road Traffic Act 1988( 1) (“ the Act”).
The Secretary of State has consulted representative organisations in accordance with section 195(2) of the Act.
1.—(1) These regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) (No. 2) Regulations 2024 and come into force on 1st April 2025.
(2) These Regulations extend to England and Wales and Scotland.
2. The Road Vehicles (Construction and Use) Regulations 1986( 2) are amended as follows.
3. In regulation 3(2) (interpretation), in the table—
(a) after the definition of “bus”, insert—
“camera-monitor system | has the same meaning as in ECE Regulation 46.04( 3) . ”; |
(b) in the definition of “overall length”, in paragraph (i)—
(i) at the end of sub-paragraph (o), omit “or”;
(ii) at end the end of sub-paragraph (p), insert—
“; or (q) any camera-monitor system. ” |
(c) in the definition of “overall width”—
(i) at the end of paragraph (n), omit “or”;
(ii) at the end of paragraph (o), insert—
“; or (p) any camera-monitor system. ”. |
4. In regulation 33 (mirrors and other devices for indirect vision)—
(a) in paragraph (1), after “(6H)” insert “and (10)”;
(b) after paragraph (9), insert—
“(10) A vehicle within scope of paragraph (1) will be deemed compliant with the requirements of this regulation if it has a camera-monitor system where the requirements in ECE Regulation 46.04, other than those at paragraphs 13, 14, and 17 to 21 of that Regulation, are met. ”.
5. In regulation 51 (sideguards)—
(a) for paragraph (2A), substitute—
“(2A) This regulation also applies to a wheeled goods vehicle, whether of a description falling within paragraph (2) or not, which is—
(a) a semi-trailer some or all of the wheels of which are driven by the drawing vehicle; or
(b) a vehicle first used on or after 1 April 2025 and which is of a type required to be fitted with lateral protection in accordance with Regulation (EU) 2018/858 of the European Parliament and of the Council of 30 May 2018 on the approval and market surveillance of motor vehicles and their trailers, and of systems, components and separate technical units intended for such vehicles( 4) . ”;
(b) in paragraph (5)(l), after “2 kilonewtons” insert “(or 1 kilonewton in the case of a vehicle described in paragraph (2A)(b))”.
6. In Schedule 2 (Community Directives and ECE Regulations), in table 2 (ECE Regulations), after the entry relating to item 21A(1), insert—
“21A(2) | 46.04 | 46 | 21.10.84 | Mirrors | 15.07.13 | - | - ”. |

These Regulations amend the Road Vehicles (Construction and Use) Regulations 1986 ( S.I. 1986/1078) to allow vehicles to use a camera-monitor system as an alternative to mirrors, and to ensure, if sideguards are required through the type approval process, that they remain fitted.
